Medical Claim Status and Resolution Plan

The claim is accepted for head, face, and nose injuries, as well as post-concussion syndrome with migraines. The claimant suffers from vision changes, dizziness, balance issues, and cognitive communication deficits. She remains totally disabled and is undergoing vestibular, cognitive, and speech therapy.

An Independent Medical Exam (IME) by Dr. Loren Rosenthal diagnosed the claimant with post-concussion syndrome, short-term memory deficits, and chronic migraine with aura, noting a guarded prognosis. The examiner suggested regular neurological consultations, psychiatric evaluation, and potential cognitive testing, noting the claimant is not yet at Maximum Medical Improvement (MMI) and holds a 50% disability rating.

A request has been filed with the Workers' Compensation Board to reduce benefits based on the IME findings, with a hearing set for August 11, 2026. As there is no current interest in a settlement, the strategy is to push the case toward MMI to achieve a Permanent Partial Disability (PPD) classification and cap future benefits.
